Photinia robusta - diseased plants

Just received an order of photinia robusta plants which look diseased. when querying this with the supplier, they responded that this is normal when they’re in pots and to plant then in the ground and they’ll flourish. I’m skeptical and planting them voids my consumer right to a refund. I would not have selected these plants from a store. Seeking advice on whether this is normal and they’ll come good if I plant them or whether to return them for a refund.

They’re NOT the most splendid specimens, but I don’t see anything seriously wrong with them. The spots and tears look like physical damage, probably from being grown close together to maximize profit/sq. ft. If you really can’t stand it return them and find another source.
